Federal Judge Orders Freedom of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks legal authority.
"Since his return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.
The case originates in a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an mistake. After his repatriation to the United States to face alien smuggling allegations, he was detained in immigration detention.
In her order, the judge noted that the government does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
